Terms of Service

These Terms govern access to thecognitionfactory.com and related services offered by The Cognition Factory (“TCF,” “we,” “us”). By using the site or services, you agree to these Terms.

App license. Installation and use of the TCF desktop/mobile application is also governed by the End-User License Agreement (EULA). If there is a conflict about App licensing, the EULA controls for that topic.

1. Who may use the site

You must be able to form a binding contract. The site is intended for adults and institutional representatives. You agree to provide accurate information on contact forms and not to misuse the service.

TCF provides educational software, methodology materials, and related information for skill-building under real constraints. Public web pages are informational. Commercial packages, pilots, or custom work may be described online but are contracted separately when applicable.

Site content, branding, documentation structure, and software (except third-party components) are owned by TCF or its licensors. You may view and share links for personal or internal evaluation. You may not republish substantial materials as your own product, resell our docs, or remove notices without written permission.

5. Third-party services

The site may rely on hosting, fonts, or form delivery providers. The App may call third-party AI APIs using keys you supply. Those services are governed by their own terms. We are not responsible for third-party outages, pricing, or data handling beyond what we disclose in our Privacy Policy.

Content is for education and skill practice. It is not legal, medical, financial, accounting, or regulatory advice. Exam outcomes, job results, and domain correctness remain your responsibility. Validate critical work with appropriate professionals and official sources.

THE SITE AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TCF AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID US.

You will defend and indemnify TCF against claims arising from your misuse of the site, your content submissions, or your violation of these Terms, to the extent permitted by law.

We may suspend or block access to the site or form endpoints for abuse or legal risk. You may stop using the site at any time.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, excluding conflict-of-law rules, unless mandatory consumer law in your jurisdiction requires otherwise. Venue for disputes will lie in state or federal courts located in Texas, subject to applicable consumer protections.

12. Changes

We may update these Terms. Continued use after the Effective date changes constitutes acceptance where permitted by law.
